Welcome to rigabrothers.com (the “Platform,” “Site,” “we,” “us,” or “our”), operated by Come Alive Video & Audio Solutions e.U., a sole proprietorship (Einzelunternehmen) registered in Austria, owned by Angelo D'Agostino, with registered office at Neustiftgasse 10/20, 1070 Vienna, Austria, VAT ID ATU76545703 (“we,” “us”).

By accessing or using rigabrothers.com, including making a pledge in support of the “Riga Brothers” documentary film (the “Film” or “Project”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

1 · Description of the Service

rigabrothers.com is a crowdfunding page enabling individuals to make a financial pledge in support of the production of the Riga Brothers documentary film. Pledges may be associated with reward tiers as described on the Site at the time of your contribution.

This is a donation/reward-based crowdfunding campaign, not an investment, securities offering, or pre-sale of a finished consumer product. Pledging does not grant you any ownership stake, revenue share, or equity in the Film, its rights, or any related entity.

2 · Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make a pledge. By using the Site, you represent that you meet this requirement and that you have the legal right to use the payment method provided.

3 · Nature of Crowdfunding & Risk Acknowledgment

Creative projects such as independent documentary films are subject to inherent uncertainty. By pledging, you acknowledge that:

• Production timelines, release dates, and final creative outcomes may change
• Reward fulfillment (where applicable) may be delayed due to circumstances beyond our reasonable control
• We will make reasonable efforts to communicate significant delays or changes to the Project via the Site or email

We are committed to using pledged funds in good faith toward the production and completion of the Film.

4 · Pledges, Payments, and Refunds

• All pledge amounts are displayed in EUR (€) and, unless stated otherwise, are inclusive of applicable VAT
• Payments are processed securely through our third-party payment processor, Stripe. We do not store your full payment card details
• Pledges are generally non-refundable once the campaign has closed and funds have been allocated toward production, except where required by applicable law
• Right of Withdrawal (EU consumers): where your pledge includes a reward that constitutes digital content or a service, you may have a 14-day withdrawal right under EU consumer protection law (implemented in Austria under the Konsumentenschutzgesetz, KSchG), unless you have expressly consented to immediate performance and acknowledged the loss of this right
• Refund requests can be directed to crowdfunding@rigabrothers.com and will be considered on a case-by-case basis prior to campaign closure

5 · Reward Fulfillment

Where a pledge tier includes a physical or digital reward (e.g., credits, merchandise, digital screener access), we will use reasonable efforts to fulfill rewards within the timeframe communicated on the Site. Estimated fulfillment dates are not guaranteed and may be subject to production delays.

6 · Intellectual Property

All content on the Site - including but not limited to the Film's title, poster, trailer, footage, stills, text, and branding - is the property of Come Alive Video & Audio Solutions e.U. or its licensors and is protected by Austrian, EU, and international copyright and trademark law. Pledging does not grant you any license to reproduce, distribute, or commercially use this content.

7 · Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to our systems or payment infrastructure
• Submit false, misleading, or fraudulent information, including via stolen or unauthorized payment methods
• Use automated systems (bots, scrapers) to access the Site without our express written permission

8 · Disclaimer of Warranties

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or completely secure, nor do we guarantee the ultimate completion, distribution, or commercial success of the Film.

9 · Limitation of Liability

To the maximum extent permitted by applicable law, Come Alive Video & Audio Solutions e.U. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or your pledge. Nothing in these Terms limits liability that cannot be excluded under applicable Austrian or EU law.

10 · Third-Party Services

The Site relies on third-party service providers, including Stripe for payment processing. Your use of the Site is also subject to the applicable terms of these providers where relevant to their functionality.

11 · Modifications

We reserve the right to modify the Site, the Project timeline, or these Terms at any time. Material changes will be communicated via the Site or by email where appropriate.

12 · Governing Law and Jurisdiction

These Terms are governed by the laws of Austria, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence if you are an EU consumer. Any disputes shall be subject to the exclusive jurisdiction of the competent court of Vienna, Austria, unless mandatory consumer protection law provides otherwise (in which case, the consumer's local court of residence applies).
